VPS terms of use

1. The service

The VPS is a virtual server rented from our provider OVH, in a data centre in France, and managed by Qalaa Tech. The Customer has administrator access (root, via sudo) with their own SSH key.

Qalaa Tech keeps a reserved administration account ("qalaa") to provide the service. The Customer must not delete it or change its key.

2. What we provide

• Secure delivery: up-to-date system, key-only login, firewall, protection against intrusion attempts.
• Automatic security updates, checked every month. If a reboot is needed, we agree on it with the Customer.
• Monitoring: we are alerted if the server stops responding.
• OVH automatic daily backup, which keeps the latest state of the server; restore at the Customer's request.

3. The Customer's responsibilities

• The applications, sites and data they install, and their security (passwords, updates of their applications).
• Their own backup copies of important data: the OVH backup does not replace a backup by the Customer.
• The ports to open in the firewall, which they tell us about or open themselves.
• Compliance with the law for the content and personal data processed on their server.

4. Prohibited uses

• Sending unsolicited messages (spam) and any open mail relay.
• Phishing, impersonation, spreading viruses or malware.
• Attacks on or scans of other systems, botnets, open proxies.
• Cryptocurrency mining.
• Unlawful content: infringement of others' rights (copyright, trademarks), hateful or defamatory content, or content exploiting minors.
• Any use contrary to the terms of our provider OVH or to the law.

5. Abuse and suspension

In case of serious abuse (attack, phishing, malware, mass spam) or a report from OVH or an authority, we may suspend the server immediately and then inform the Customer.

For any other breach, we ask the Customer to end it within 48 hours before any suspension. In case of serious or repeated breach, the service may be terminated without refund of the current period.

6. Confidentiality and data

We do not access the Customer's data, except at their request, for the security or maintenance of the server, or where required by law, and only as far as strictly necessary.

VPS data is stored in France. For the personal data processed on it, the Customer is the data controller and informs the persons concerned.

7. End of service

At the end of a paid period that is not renewed, the server is terminated at OVH and its data is permanently erased, backup included. The Customer retrieves their data before that date; we can help on request.
