Terms of sale

1. Who sells

Services are sold by Harrouz Abdallah, self-employed entrepreneur (auto-entrepreneur), Ain Smara, Constantine, Algeria (auto-entrepreneur card no. 107806020250025218, tax ID (NIF) 17816010250019902580), under the trade name Qalaa Tech ("Qalaa Tech", "we"). The "Customer" is the adult person or organisation placing the order.

2. Services

• Domain names: search, registration in the Customer's name with the registry, setup and renewal follow-up.
• "Qalaa Europe VPS" private servers: a virtual server rented from our provider OVH in France and managed by Qalaa Tech, under the VPS terms of use.
• Managed hosting, websites, software and apps: on quote. The accepted quote sets out the service, price and timeline; it prevails over these terms where they differ.

3. Ordering

Domain name: the Customer fills in the order form and receives by email a reference, the price and the payment details. The price is held for the period stated (48 hours).

VPS: the Customer sends a request from the website. We confirm availability, the total price and the delivery time by email.

By ticking the box provided, the Customer accepts these terms (and, for a VPS, the VPS terms of use). We record the date and the version accepted. The contract is concluded when payment is received.

4. Prices

Prices are shown in Algerian dinars (DZD); the amount shown is the total amount payable. They are calculated from our providers' costs and the exchange rate, and may therefore change.

The price confirmed to the Customer is fixed for the current order. A renewal is charged at the current price, stated in the reminders sent before the due date.

5. Payment

Payment is made in advance, by BaridiMob or by deposit to a CCP account, quoting the order reference. The Customer sends us the receipt.

No service is ordered from our providers before payment is received.

6. Delivery

• Domain name: registered in the Customer's name (registrant) once payment is confirmed; the Customer is notified by email.
• VPS: delivered secured after payment is received, within the confirmed time; access details are sent by email. Login uses the Customer's SSH key, never a password sent by email.
• If we cannot deliver (for example, the provider is out of stock), the Customer is refunded in full.

7. Term and renewal

A domain name is registered for one year. A VPS is paid in advance for 3, 6 or 12 months.

We write to the Customer 30, 15 and 7 days before the due date. Without payment by the due date, the domain name is not renewed and the VPS is terminated at the end of the paid period: its data is then permanently erased. The Customer is responsible for retrieving it beforehand.

8. Cancellation and refunds

Before delivery begins, the Customer may cancel the order: the amount paid is refunded.

A registered domain name cannot be cancelled. A VPS period that has started is not refunded, unless we have failed to perform. These rules apply without prejudice to the rights the law grants to consumers.

9. Our commitments and their limits

We perform the services with care and according to good practice. Uninterrupted availability cannot be guaranteed: maintenance, failure or incident at a provider, attack.

Except in case of gross or wilful misconduct, our liability is limited to direct damage and to the amount paid by the Customer for the service concerned over the last 12 months. The Customer remains responsible for the content and applications they publish or install.

10. Personal data

Data provided when ordering is processed as described in the "Personal data" section of the legal notice.

11. Changes to these terms

We may change these terms. The version applicable to an order is the one accepted by the Customer when placing that order.

12. Governing law and disputes

These terms are governed by Algerian law. In the event of a dispute, we first seek an amicable solution: write to us at contact@qalaatech.com. Failing agreement within 30 days, the dispute is brought before the competent courts of Constantine.
